Coverage Counsel, Commercial Liability Claims
Overview
This role owns complex coverage decisions for commercial liability claims with significant financial and reputational exposure. Reporting to the Chief Claims Officer, the counsel partners with claims, underwriting, and product teams to interpret CGL, Excess/Umbrella, and Professional Liability policies. The position manages coverage disputes from evaluation through litigation, including oversight of outside counsel. It stands out for direct involvement in high-stakes disputes and shaping policy language based on claims insights.
What You'll Do10
- 1Provide legal guidance on complex coverage matters for commercial liability claims, including CGL and Excess/Umbrella policies.
- 2Interpret policy language, endorsements, and underwriting materials to assess coverage obligations.
- 3Draft reservation of rights letters, coverage position letters, and disclaimers.
- 4Advise claims professionals on coverage strategy, settlement considerations, and litigation exposure.
- 5Evaluate multi-policy claims with overlapping coverage, priority of coverage, and allocation issues.
- 6Manage declaratory judgment actions and coverage litigation, including selecting and overseeing outside counsel.
- 7Participate in mediations and settlement conferences for significant coverage disputes.
- 8Collaborate with underwriting and product teams to improve policy language and address emerging coverage issues.
- 9Monitor legal and regulatory developments affecting commercial liability coverage and communicate impacts.
- 10Deliver training to claims teams on coverage analysis and policy interpretation.
Requirements10
- 1JD from an accredited law school and active bar license in at least one U.S. state.
- 27-10 years of experience in insurance coverage, complex liability claims, or coverage litigation.
- 3Substantial experience analyzing CGL and Excess/Umbrella policies.
- 4Experience with Commercial Auto, Professional Liability, or E&O coverages.
- 5Prior litigation experience at a law firm, including discovery, motion practice, and depositions.
- 6Strong skills in drafting coverage opinions and position letters.
- 7Experience managing outside counsel and complex litigation.
- 8Ability to evaluate legal risks and provide business-oriented recommendations.
- 9Excellent written and verbal communication for legal and non-legal audiences.
- 10Organizational skills to manage multiple complex matters in a deadline-driven environment.
