Copyright & DMCA Policy

1. Copyright Ownership

All original content, design, code, graphics, text, data compilations, algorithms, and other materials created by NearSkill Jobs and available on the Platform are the exclusive intellectual property of NearSkill Jobs and are protected by applicable copyright, trademark, and intellectual property laws of India and other jurisdictions. This includes but is not limited to: the NearSkill Jobs name and logo, website design and user interface, proprietary algorithms and data structures, job enrichment and curation methodologies, original written content, and the selection and arrangement of information on the Platform.

Job listings, employer names, company logos, trademarks, and other employer-provided content displayed on the Platform remain the intellectual property of their respective owners. Resumes, profiles, cover letters, and other content submitted by Candidates remain the intellectual property of the respective Candidates.

2. Third-Party Content on the Platform

The Platform displays content that is provided by third parties, including but not limited to: job descriptions and listings provided by employers and recruiters; company names, logos, and branding materials; candidate resumes, profiles, and application materials; and content aggregated from publicly available sources. NearSkill Jobs does not claim ownership of third-party content and displays such content on the Platform for informational and operational purposes in connection with our services.

NearSkill Jobs respects the intellectual property rights of others and expects Users of the Platform to do the same. We have adopted this Copyright Policy to provide a clear process for reporting claims of copyright infringement.

3. Reporting Copyright Infringement

If you believe that any content available on or through the Platform infringes your copyright, trademark, or other intellectual property rights, you may submit a written notification (“Takedown Notice”) to our designated Copyright Agent. Your Takedown Notice must include all of the following information:

1. A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property right that is allegedly infringed.
2. A detailed description and identification of the copyrighted work, trademark, or other intellectual property that you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.
3. A detailed description and identification of the material that you claim is infringing, including the specific URL(s) or location(s) on the Platform where the allegedly infringing material is located, sufficient to allow us to locate the material.
4. Your full legal name, physical address, telephone number, and email address so that we may contact you regarding your complaint.
5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright or intellectual property owner, its agent, or the law.
6. A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright or intellectual property owner or are authorized to act on behalf of the owner.

4. Takedown Process

Upon receipt of a valid and complete Takedown Notice that substantially complies with the requirements set forth in Section 3 above, NearSkill Jobs will:

1. Promptly investigate the claimed infringement and review the Takedown Notice for completeness and validity.
2. Take appropriate action, which may include: removing or disabling access to the allegedly infringing material; notifying the User who posted or submitted the material (if identifiable); and/or terminating the accounts of repeat infringers in appropriate circumstances.
3. Notify the complainant of the action taken, where appropriate.

NearSkill Jobs reserves the right to reject Takedown Notices that are incomplete, fail to substantially comply with the requirements above, contain false or misleading information, or relate to material that is clearly not infringing (e.g., fair use, de minimis use, or content that is not copyrightable).

5. Counter-Notification

If you believe that material you posted or submitted to the Platform was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification (“Counter-Notice”) to our Copyright Agent at the contact information provided above. Your Counter-Notice must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location where the material appeared before it was removed or disabled.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your full legal name, physical address, telephone number, and email address.
5. A statement that you consent to the jurisdiction of the courts located in Mumbai, Maharashtra, India, and that you will accept service of process from the person who submitted the original Takedown Notice or an agent of that person.

Upon receipt of a valid Counter-Notice, NearSkill Jobs may, at its discretion, restore the removed material within a reasonable timeframe unless the original complainant files a court action against you seeking to restrain the allegedly infringing activity.

6. Repeat Infringer Policy

In accordance with applicable copyright laws and our Terms of Service, NearSkill Jobsreserves the right to terminate, suspend, or restrict the accounts and access of Users who are determined to be repeat infringers of copyright or other intellectual property rights. A repeat infringer is a User who has been the subject of multiple valid Takedown Notices or who has otherwise demonstrated a pattern of infringing activity on the Platform.

7. False Claims

Submitting a Takedown Notice or Counter-Notice that contains false, misleading, or materially inaccurate information may result in legal liability. NearSkill Jobsreserves the right to seek damages, costs, and attorneys’ fees from any party who knowingly and materially misrepresents that material is infringing or that material was removed by mistake. You may wish to consult an attorney before filing a Takedown Notice or Counter-Notice.
